These Terms of Service (“Terms”) govern your access to and use of DailyeMotive.com (the “Site”), including browsing templates, previews, and related pages. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About the Service
DailyeMotive.com provides a gallery of interactive mobile templates and related digital experiences for inspiration, preview, and campaign use as described on the Site. Features may change over time.
2. Eligibility
You must be able to form a binding contract under applicable law to use the Site. You are responsible for your use of the Site and for keeping any account credentials secure if accounts are offered.
3. Acceptable Use
You agree not to:
- Use the Site for unlawful, harmful, fraudulent, or abusive purposes
- Attempt to disrupt, scrape excessively, reverse engineer, or compromise the Site or its infrastructure
- Misrepresent your identity or affiliation when contacting us
- Use templates or content from the Site in ways that infringe third-party rights or applicable law
- Circumvent rate limits, security controls, or access restrictions
4. Intellectual Property
The Site, including its design, branding, text, software, graphics, animations, audio, and template layouts, is owned by DailyeMotive.com or its licensors and is protected by copyright and other intellectual property laws.
Viewing templates on the Site does not grant you ownership of those designs. Any download, commercial use, redistribution, or customization rights are subject to separate licensing terms we provide for that template or product. Unauthorized copying or resale is prohibited.
5. User Submissions
If you send us messages, feedback, or other content through the contact form or email, you grant us a non-exclusive right to use that material to respond and improve our services. Do not submit confidential or unlawful content.
6. Third-Party Services
The Site may use third-party services such as analytics and advertising (including Google Analytics and Google AdSense when enabled). Your use of those services may be subject to their own terms and privacy policies.
7. Advertising
The Site may display advertisements. We are not responsible for third-party advertiser content, products, or websites linked from ads. Interactions with advertisers are solely between you and the advertiser.
8. Disclaimer of Warranties
The Site and templates are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, or that templates will meet your specific campaign needs.
9. Limitation of Liability
To the fullest extent permitted by law, DailyeMotive.com and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed the greater of (a) the amount you paid us (if any) for the specific product or service giving rise to the claim in the 12 months before the claim, or (b) USD $50.
10. Indemnification
You agree to indemnify and hold harmless DailyeMotive.com and its operators from claims arising out of your misuse of the Site, your violation of these Terms, or your infringement of others’ rights.
11. Changes
We may update these Terms and the Site features at any time. Continued use after changes means you accept the updated Terms. The “Last updated” date above reflects the latest revision.
12. Termination
We may suspend or restrict access to the Site if we believe you have violated these Terms or pose a risk to the Site or others.
13. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where the Site operator is established, without regard to conflict-of-law principles, except where mandatory consumer protections in your country apply.
